Tier Terms of Use
Effective date: October 19, 2026
These Terms of Use (“Terms”) are an agreement between you and Arsen Palamarchuk (“we”, “us”) about your use of the Tier app (“Tier”). By downloading or using Tier, you agree to these Terms and to our Privacy Policy at https://curiositydrivenapps.com/tier/privacy. If you do not agree, do not use Tier.
1. The app
Tier is a workout tracker that logs your training, suggests programs and estimates strength ranks. Tier is free to use, and some features need a Tier Pro subscription (section 3).
2. Health and safety
Tier is not medical advice and is not a medical device. Programs, targets and ranks are general information, not a personal prescription. Talk to a doctor before starting a new exercise program, especially if you have a health condition, an injury or are pregnant. Stop exercising if you feel pain, dizziness or shortness of breath. Lift with good technique and a spotter or safety equipment when appropriate. You train at your own risk.
Ranks are estimates. Barbell ranks compare an estimated one-rep max with public results from raw powerlifting meets (OpenPowerlifting, public domain). Pull-up and push-up ranks compare your reps with the U.S. Marine Corps Physical Fitness Test standards. Tier is not affiliated with or endorsed by OpenPowerlifting or the U.S. Marine Corps. A rank does not certify your strength or fitness.
3. Tier Pro subscription
- Plans. Tier Pro is an auto-renewing subscription, offered yearly and monthly. The current prices, the billing period and any free trial or introductory price are shown in the app before you buy. Prices may vary by country and include any taxes the App Store applies.
- Payment. Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends if you start one.
- Free trial. Eligible new subscribers can start a 7-day free trial of the yearly plan. Unless you cancel at least 24 hours before the trial ends, it becomes a paid yearly subscription at the price shown when you started it. If you buy a subscription during a trial, the unused part of the trial ends. Apple allows one free trial or introductory price per Apple Account.
- Introductory price. When offered, the first year of the yearly plan costs the introductory price shown in the app, then renews at the regular yearly price.
- Auto-renewal. Your subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the current period ends, at the then-current price.
- Managing and canceling. Manage or cancel in Settings → Apple Account → Subscriptions on your iPhone, or from Tier’s Settings → Manage subscription. Canceling stops the next renewal; Pro stays active until the end of the period you paid for.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple under its policies at https://reportaproblem.apple.com. We cannot issue refunds ourselves.
- Price changes. If the price changes, Apple notifies you in advance and, where required, asks for your consent before the new price applies.
- Restoring. Use Restore purchases on a new iPhone or after reinstalling Tier, signed in with the same Apple Account.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Tier on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or redistribute Tier except as the law allows. Tier, its design, ranks, programs, exercise guides and artwork belong to us or our licensors.
5. Your data
Your workouts and notes are yours. Tier stores them on your iPhone and in your iCloud Drive (see the Privacy Policy). You are responsible for keeping your iPhone and iCloud backups; we cannot recover data we never had.
6. Acceptable use
Do not use Tier for anything unlawful, do not try to break or bypass its subscription checks, and do not use share cards to mislead others about your results.
7. Disclaimers
Tier is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that Tier will be error-free or that ranks, targets or estimates are accurate for you.
8. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, loss of data or loss of profits arising from your use of Tier or your training. Our total liability for any claim is limited to the amount you paid for Tier Pro in the 12 months before the claim. Some places do not allow these limits, so they may not fully apply to you.
9. Ending these Terms
You can stop using Tier at any time by deleting it; cancel your subscription separately as described in section 3. We may suspend or end your license if you break these Terms.
10. Changes
We may update these Terms. We will change the effective date above and, for significant changes, tell you in the app or in the App Store release notes. Continuing to use Tier after a change means you accept it.
11. Governing law
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise.
12. Apple
These Terms are between you and us, not Apple, and also include the following terms, which Apple requires:
- Responsibility. We, not Apple, are solely responsible for Tier and its content.
- Maintenance and support. We alone are responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for Tier.
- Warranty. If Tier fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law permits, Apple has no other warranty obligation for Tier. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to any warranty are our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Tier or your use of it, including product liability claims, claims that Tier fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with Tier’s use of HealthKit.
- Intellectual property. If a third party claims that Tier or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must follow any third-party agreements that apply when you use Tier, such as your wireless data service agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
